Service Agreement

(a) GENERAL SERVICES: DKS Computer Services agrees to provide IT related services as requested by you, hereafter referred to as "the client". These services may include but are not limited to consultation, diagnosis, configuration, installation, and repair. DKS Computer Services will make every effort in good faith to fully complete any service contracted. In certain cases however, services may not be able to be performed or completed due to circumstances beyond the control of DKS Computer Services. In such cases, the client agrees to fully compensate DKS Computer Services for services rendered. The client also agrees to compensate DKS Computer Services for all materials and expenses incurred in providing services, even those which remain incomplete. Additionally, the client agrees to compensate DKS Computer Services for reasonable time spent in the attempt to provide service(s) not completed so long as DKS Computer Services is not directly responsible for circumstance(s) preventing completion of service(s).

(b) CLIENT RESPONSIBILITIES: The client understands and agrees that these terms and conditions shall be the operating agreement for any requested services in the absence of any other agreement. The client understands and agrees that prior to contracting or allowing DKS Computer Services to perform diagnostic, repair, or other services on the clients systems, it is the responsibility of the client to back-up all data, software, information, and/or other files stored on any affected hardware, including but not limited to tape backups, hard drives, and/or solid state media. The client acknowledges and agrees that DKS Computer Services shall not be responsible under any circumstance for any loss or corruption of data and/or software.

Service Limitations and Liability

(a) LIMITATIONS TO SERVICE: DKS COMPUTER SERVICES RESERVES THE RIGHT TO REFRAIN FROM PROVIDING ANY OR ALL REQUESTED COMPUTER SERVICES AND INSTEAD REFUND PAYMENT TO THE CLIENT, WHOLLY OR IN PART, ON THE BASIS THAT THE CLIENT'S TECHNICAL NEEDS OR OTHER REQUIREMENTS ARE UNUSUAL OR EXTENSIVE AND BEYOND THE SCOPE OF THIS SERVICE AGREEMENT AS REASONABLY DETERMINED BY DKS COMPUTER SERVICES. DKS COMPUTER SERVICES RESERVES THE RIGHT TO REFUSE OR DISCONTINUE SERVICES TO ANY CLIENT ON THE BASIS OF CONDUCT (ie. if the client exhibits excessively rude, aggressive, or abusive behavior towards any employee, contractor, vendor, or associate of DKS Computer Services).

(b) FORCE MAJEURE: If DKS Computer Service’s ability to render computer services is impaired by the client or circumstances beyond the control of DKS Computer Services, DKS Computer Services may choose not to provide or to discontinue computer services.

(c) LIMITATION OF LIABILITY: To the extent permitted by law, the client agrees that DKS Computer Service’s total liability for damages related to services provided is limited to the total amount paid for said services. Furthermore the client releases DKS Computer Services from liability for any indirect, incidental, special, or consequential damages. DKS COMPUTER SERVICES IS NOT LIABLE FOR LOSS, ALTERATION, OR CORRUPTION OF ANY DATA NOR FOR THE CLIENT'S INABILITY TO UNDERSTAND AND/OR PROPERLY UTILIZE A PROVIDED PRODUCT OR SERVICE IN THE EVENT THAT SAID PRODUCT OR SERVICE WAS PROVIDED IN ACCORDANCE WITH THE PROVISIONS OF THIS AGREEMENT.

Service Warranty

IF YOU ARE UNSATISFIED WITH A PRODUCT OR SERVICE PROVIDED BY DKS COMPUTER SERVICES, PLEASE CALL (415) 997-9357 AND ALLOW US TO RESOLVE YOUR ISSUE QUICKLY AND COURTEOUSLY.

DKS Computer Services warrants all hardware repair services and installations for thirty (30) calendar days following the date of the repair/installation. All new hardware and/or equipment will be covered by the respective manufacturer's warranty unless otherwise stated. Used hardware or equipment carries no warranty unless specifically stated in a seperate service or equipment contract. All other services are warranted to the extent that functionalities are provided and work is performed as contracted for upon completion of services. In the event the client believes contracted functionalities are not present or contracted work has been left incomplete, the client may contact DKS Computer Services within ten (10) business days upon completion of services to resolve any outstanding issues. For services related to malware removal, services are warranted only if DKS Computer Services installs and configures approved security software in conjunction with aforementioned services.
